General Terms and Conditions of Sale
These General Terms and Conditions of Sale determine the terms that apply to sales conducted by any person (the customer) purchasing SKUAM products on the website www.skuam.com, owned by TERRE DE JUMPING, a company under French law registered at the Trade and Companies Register of Evreux under number 492 878 293.
Article 1 – Purpose
Any order placed for a product in the online shop of this website presupposes prior consultation and acceptance of these General Terms and Conditions of Sale.
We reserve the right to amend these General Terms and Conditions of Sale at any time. The applicable General Terms and Conditions of Sale are those in force on the date the order is confirmed.
Any order of our products represents acceptance by you without reservation of these terms when you confirm your order.
Article 2 – Price
The prices of our products are indicated in euros including taxes (VAT and other taxes that are applicable on the date of the order), excluding shipping costs.
If an order is placed to be shipped to a country other than mainland France, you are the importer of the product(s) concerned. Customs duties, other local taxes, import duties or State taxes may be due. TERRE DE JUMPING is not liable for these duties and amounts. They shall be paid by you and you are liable for them. Therefore, it is your responsibility to make declarations and payments to the relevant authorities and bodies of your country.
All orders, whatever country they originate from, are payable in euros.
TERRE DE JUMPING reserves the right to change its prices at any time. Our products shall be invoiced based on the rate in force at the time the order is confirmed and subject to availability.
Our products remain the property of TERRE DE JUMPING until the price is paid in full. Once you are in possession of the products ordered, the risks of loss of or damage to the products are transferred to you.
Article 3 – Orders
Any confirmation of an order implies your complete and full commitment to these General Terms and Conditions of Sale, without exceptions or reservations. Supplying all the data and registered confirmation shall mean that the transaction is accepted. You declare that you are entirely aware of this.
A summary of the information in your order shall be sent to you by email, using the email address used to confirm your order.
TERRE DE JUMPING reserves the right not to register a payment and not to confirm an order for any reason, and more particularly in the event of a supply problem, or in the event of a difficulty concerning the order received.
The photos representing the products in our online shop are for information purposes only and are not contractual. TERRE DE JUMPING may therefore have to deliver a product to the customer that is slightly different to the product seen by the client on the site.
Article 4 – Payment
The method of payment accepted on this website is as follows: PayPal. The products remain the sole property of TERRE DE JUMPING until payment for the order is received in full. The order shall be shipped when the customer’s account has been debited to pay TERRE DE JUMPING. From the actual delivery date, the customer is liable for the risks relating to their product (loss, damage, theft, etc.).
Article 5 – Invoicing
The invoice shall be sent to the email address given when the order is placed. Any error made by the client when entering the information relating to the order may not be held against TERRE DE JUMPING.
Article 6 – Retraction and Returns Process
Products must be returned in their original state and intact (packaging, accessories, instructions).
You are liable for this. Any damage to a product that is returned could annul your right of retraction.
Return costs shall be borne by the customer. TERRE DE JUMPING shall bear the cost of sending a new product, within the 14-day retraction period only.
If the right of retraction is exercised, TERRE DE JUMPING shall refund the amounts paid within 14 days following notification of your request. The refund method shall be the method of payment used by the customer to pay for the order.
Article 7 – Complaints
The customer has a duty to check that the product complies with their order within 48 hours of receipt. If the product is non-compliant (the product does not match the order), the customer must contact Customer Services to make a complaint. After the 48-hour period has passed, any complaint shall be rejected.
Product returns by the customer must have been expressly accepted by Customer Services.
Article 8 – Availability
The products offered for sale on this site are subject to stock availability. If the product is unavailable after your order has been placed, you shall be informed via email. Your order and the bank transaction shall then be automatically cancelled.
Article 9 – Delivery
The products ordered shall be delivered to the delivery address given during the ordering process, within the time-scale indicated on the order confirmation page.
In the event of a delivery delay, an email shall be sent to you to inform you of this. TERRE DE JUMPING may not be held liable for late delivery or breach of contract if the delay or failure is as a result of unforeseeable and unavoidable circumstances, a third party to the contract or a case of force majeure.
The delivery method used by TERRE DE JUMPING is as follows: Colissimo. TERRE DE JUMPING may not be held liable for a delivery delay due solely to the postal service or the customer being unavailable if the parcel has to be retained by the postal service.
The customer must inform Customer Services of any delivery failure or delay within 8 calendar days following the planned delivery date. After 30 days following confirmation of the order, the claim may not be dealt with.
Article 10 – Guarantee
All our products have the legal guarantee of compliance and the guarantee covering hidden defects laid down in Articles L211-4 to L211-3 of the French Code de Consommation (Consumer Code) and 1641 onwards of the French Code Civil (Civil Code). If a product sold is non-compliant, it may be returned, exchanged or refunded.
All complaints and exchange or refund requests must be made by post (TERRE DE JUMPING, 6 rue des Motelles, 27600 Saint-Aubin-sur-Gaillon, France) or by email (firstname.lastname@example.org) within 30 calendar days of delivery.
Refer to Article 6 for the returns process for your product.
Article 11 – Liability
The products available on this website comply with current French legislation. TERRE DE JUMPING may not be held liable if a product does not comply with the legislation of the country to which it is delivered. It is your responsibility to check with the local authorities whether the products you intend to order may be imported or used.
In addition, TERRE DE JUMPING may not be held liable for damage arising from:
- Poor use of the product,
- Use that is not in accordance with the purpose of the product,
- Normal wear and tear of the product,
- Transport or storage of the product,
- Failure to comply with the maintenance instructions,
- Modification of the product,
- An impact caused by sharp objects, torsion, compression, a fall, an abnormal impact or other actions outside of our control.
Article 12 – Applicable law in the event of a dispute
These General Terms and Conditions of Sale are subject solely to French law. In the event of a dispute, an amicable solution shall be preferred before any action is brought before the courts. Customer Services shall deal with complaints and disputes with the utmost attention.
The Court of Evreux shall have sole jurisdiction in the event of a dispute.
Article 13 – Legal provisions
No modification to the General Terms and Conditions of Sale by the customer shall be upheld unless it has been drawn up, dated and signed by both parties.
If one of the clauses of these General Terms and Conditions of Sale is invalid or inapplicable, this shall not under any circumstances affect the application or validity of the other clauses of the General Terms and Conditions of Sale. The clause in question shall then be replaced by the closest possible provision.
